HVNL Reforms:
Why Statutory Liability cover matters more than ever
The Heavy Vehicle National Law (HVNL) continues to evolve, with significant reforms taking effect from 1 August 2026.
How we got here
The modern HVNL exposure began in October 2018 with the introduction of the Chain of Responsibility (CoR) reforms.
Those reforms moved liability beyond transport operators and drivers, imposing positive duties on a wide range of parties who influence transport activities, including:
- Employers
- Prime contractors
- Consignors and consignees
- Schedulers
- Loaders
- Vehicle operators
- Directors and senior managers

What has changed in 2026
The latest reforms do not create new executive duties. Rather, they increase the standard against which compliance will be assessed.
Key reforms include:
|
Mandatory Safety Management Systems (SMS) for accredited operators.
|
Greater focus on organisational systems, governance and due diligence.
|
The practical effect is that regulators are increasingly examining whether a business had effective systems in place to manage transport risk, rather than focusing solely on the actions of individual drivers.

How DUAL's Management Liability policy responds
In 2024, DUAL introduced an affirmative HVNL endorsement to provide greater certainty around coverage under our Management Liability policy.
DUAL's Management Liability policy includes Statutory Liability cover which may respond to HVNL investigations and prosecutions, subject to policy terms, conditions and exclusions.
This includes potential cover for:
- Defence costs incurred responding to HVNL investigations and prosecutions.
- Pecuniary penalties for Category 2 and Category 3 offences where insurance is not legally prohibited.
- Enforceable Undertaking Expenses, including costs associated with training, audits, compliance upgrades and other initiatives required under an enforceable undertaking.
- Legal representation and regulatory response costs arising from NHVR investigations.
HVNL claims scenarios
The financial impact of an HVNL investigation can extend beyond the penalty itself, with investigation and legal defence costs potentially adding significantly to the overall cost of a matter.
The following claims scenarios illustrate the types of HVNL matters businesses and individuals may face, and the potential costs associated with responding to an investigation or prosecution.
Claim 1: Vehicle Dimension Breach
Claim summary:
A freight operator was investigated after a heavy vehicle was found to exceed permitted dimensional limits while operating on a public roadway. Regulators alleged the company had failed to ensure its pre-departure compliance processes adequately identified the breach before the vehicle entered service.
Penalty, investigation costs and defence costs:
The company was convicted and fined approximately $14,000. The prosecution was defended at a cost of approximately $30,000 including investigation costs.
Claim 2: Vehicle Overloading Breach
Claim summary:
A logistics company was investigated after a roadside inspection identified a heavy vehicle combination that significantly exceeded permitted mass limits. Regulators alleged the company failed to maintain adequate loading procedures and compliance controls to ensure vehicles operated within statutory limits.
Penalty, investigation costs and defence costs:
The company was convicted and ordered to pay penalties and associated costs totalling approximately $12,000. Legal defence costs associated with the prosecution, as well as investigation costs incurred, were approximately $45,000.
Claim 3: Chain of Responsibility Safety Systems Failure
Claim summary:
A transport company faced prosecution under Chain of Responsibility obligations following allegations that it had failed to implement adequate transport safety systems. The alleged deficiencies included insufficient driver inductions, inadequate fitness-for-work procedures and a lack of effective fatigue management controls.
Penalty, investigation costs and defence costs:
The company was convicted and fined approximately $65,000. Given the complexity of the prosecution and expert evidence involved, defence costs and investigation costs were approximately $95,000.
Claim 4: Driver Fatigue and False Records
Claim summary:
A driver came under investigation after he was found to have completed a long-haul journey that could not reasonably have been undertaken within permitted driving hours. Regulators alleged that work diary entries had been falsified to conceal breaches of fatigue management requirements and mandatory rest periods.
Category 2 penalty, investigation costs and defence costs:
The driver was ultimately convicted of a Category 2 offence and received fines totalling approximately $8,500, together with court costs. Defending the prosecution, including legal representation and court appearances, cost approximately $15,000.
Which states does the legislation apply
While the recent HVNL reforms apply across the participating jurisdictions of New South Wales, Queensland, Victoria, South Australia, Tasmania and the ACT, it is important to note that Western Australia and the Northern Territory remain outside the HVNL framework. Instead, both jurisdictions maintain their own heavy vehicle legislation and regulatory regimes, with compliance and enforcement administered by local authorities rather than the National Heavy Vehicle Regulator (NHVR).
Despite this, operators based in WA or the NT are not entirely insulated from the HVNL. When heavy vehicles travel into participating jurisdictions, they become subject to the HVNL and the oversight of the NHVR for those operations. As a result, transport businesses operating across state borders may need to comply with both local laws and the HVNL, depending on where their transport activities occur.
Why this matters
NHVR enforcement continues to focus increasingly on systemic failures rather than isolated driver conduct. Directors, officers and businesses across the supply chain can be investigated and prosecuted for failures relating to scheduling, loading practices, fatigue management, contractor oversight and broader safety governance.
As businesses adapt to the 2026 reforms, effective compliance frameworks are becoming increasingly important. Equally important is understanding how insurance may respond when regulatory investigations, prosecutions or enforceable undertakings arise.
DUAL's Management Liability policy is designed to provide brokers and insureds with greater confidence in navigating an increasingly complex HVNL landscape, by providing cover for defence costs, eligible pecuniary penalties and Enforceable Undertaking Expenses, subject to the policy terms and conditions.
